The High Court has ruled that the name YouView infringes on an existing company’s trademark. As a result, the TV service may have to find a new name. But does this affect you?
YouView may have to change its name.
The news comes after the High Court ruled that the TV service had infringed on another company's trademark. Back in 2006, telecoms firm Total trademarked the name 'YourView' for one of its products, and in the court this week, the judge concluded that YouView was 'confusingly similar'.
So now, Total plans to get an injunction against YouView to prevent it from trading with the brand in future. But, of course, YouView isn't going down without a fight, stating that it will appeal the decision. A spokesperson said: "We maintain there is no confusion between our consumer-facing TV service, YouView, and the business-to-business billing platform, YourView, provided by Total Ltd."
Total's lawyers are having none of it though, saying: "YouView were made well aware of Total's rights before they launched the service under the infringing name yet they chose to launch it under that name regardless."
So things are up in the air at the moment, with plenty of court action still to play out by the sounds of it. However, it is looking increasingly possible that YouView will have to find a new moniker.
Of course, a name change isn't the end of the world. I mean, it'll cause a bit of faff for the likes of BT and TalkTalk. Us too - someone's going to have to update all our informative - but numerous - YouView guides. Probably muggins here (grumble, grumble).
Still, YouView would still be the same basic service as before, the integrated catch-up would be as convenient, and all the extras that BT and TalkTalk offer, like Sky channels and on-demand box sets, would remain present and correct. As William Shakespeare himself said: "What's in a name? That which we call a rose by any other name would smell as sweet."
